The Problem with Cloud AI Under GDPR
When an employee pastes a client email into ChatGPT, they have transferred personal data to a US company under terms their employer almost certainly never reviewed. Under GDPR Article 28, your organisation is responsible for ensuring any data processor provides sufficient guarantees. Most cloud AI providers offer a Data Processing Agreement, but these are complex, often insufficient, and place the compliance burden on your organisation.
The Italian Data Protection Authority temporarily banned ChatGPT in 2023 over exactly these concerns. Germany's DSK issued guidance warning against using cloud AI for processing personal data. Austrian data protection cases have repeatedly found that Google Analytics transfers violate GDPR — the same logic applies directly to cloud AI services.
Local AI as a Compliance Strategy
Running AI locally is not just a privacy preference — for many European businesses, it is the only legally defensible option for processing anything that qualifies as personal data. When the model runs on your hardware and the data never leaves your network, there is no third-party transfer to worry about. GDPR Article 5(1)(f) — integrity and confidentiality — is satisfied by design.
